Comment on Food Patents – Can I patent a food or recipe? by M. Lica https://inventingpatents.com/index.php/2015/08/25/food-patents-can-i-patent-a-food/#comment-181 Mon, 18 Mar 2019 15:25:17 +0000 http://inventingpatents.com/?p=338#comment-181 I am a single mother looking to secure the future of my children and myself. I developed a recipe, new “twist” on very popular food that can be eaten as a snack or a meal. Anyone I have served it to has expressed their appreciation by smacking their lips and asking for more.
I would like to bring it to the market as a convenience food in the frozen food section, but need to know if I can patent it first. I would also like to know if it might be more profitable for me to bring it to investors, manufacture and market it or to sell it to a large corporation. Despite my “twist” per change of this food, it is important to note that this is a food that is eaten every day by millions of people worldwide.

Dear Richa,
You can claim them in a same application. Since they are acting together, therefore their combined action should be elaborated in one application. Further, you should claim a composition having amount of extract of two herbs.

Experience in both the beer drinking and cannabis usage areas is extensive, but seldom combined.

Comment on U.S. Patent No. 6,630,507 to Methods of Using Marijuana by Randall Vee https://inventingpatents.com/index.php/2013/10/03/us-patent-66305070-methods-using-marijuana/#comment-88 Sat, 27 Oct 2018 06:32:34 +0000 http://inventingpatents.com/?p=1092#comment-88 In reply to James Gunther.

Lest we not forget, our nation IS A CORPORATION.
There’s nothing in the constitution that prevents the government from patenting anything, including cannabis and cannabinoids.
There’s nothing in the constitution that states our government’s first duty is to the citizens.
Nothing prevents corporations from being able to patent discoveries. They only have to be the first one to be granted the number. After that, we’re not getting it back without a legal battle, and believe me that they will bring high powered lawyers and shoot down any challenges that can benefit us.
Big pharma has their claws firmly entrenched in the backs of the legislature, and they’re not going to simply give you a cheap, effective solution to your maladies and malaise simply because they are such nice people. They want patents so they can charge you a fortune to be healthy and happy. They can charge you whatever they want for any patent medicine and nothing anyone can do or say will change it, unless you can change patent laws.
Big pharma/Big Medical has not released ANY new drugs or treatments that can actually CURE a disease into the US market for over 30 years! Everything is palliative care only, which keeps us coming back for more and more pills and treatments.

Thank you!
